International law has occupied a central position in the political conflict that consumed the Atlantic community in 2002-2003. This fact makes it an ideal focal point for considering whether or not relations between the United States and Europe have changed fundamentally, at least with respect to the rules and norms of process that regulate this relationship. Michael Byers will focus on two firmly established, foundational rules of international law, namely the right of self-defense and the general rule of interpretation, and follows their course through the geopolitical transformations of the last two decades.
Michael Byers argues that the ways in which these rules have been approached by the United States and European countries have remained remarkably constant. This consistency may be a reflection of the fact that, within the Atlantic community, similarities in identities and interests still outweigh the differences. Indeed, the contemporary international legal system is predominantly a joint creation of Western Europe and the United States, and these countries therefore have a strong interest in maintaining, strengthening, and only occasionally-and cautiously-altering the rules. There is no trans-Atlantic crisis, at least not with respect to foundational rules.
Professor Michael Byers holds the Canada Re-search Chair in Global Politics and International Law at the University of British Columbia in Vancouver, Canada. Prior to 2005, he was a Professor of Law at Duke University; from 1996-1999 he was a Fellow of Jesus College, Oxford. Professor Byers writes and teaches on issues of military force, the laws of war, terrorism, international criminal law, human rights, the United Nations, and international politics. He is the author of War Law: Understanding International Law and Armed Con-flict (Atlantic Books) and Custom, Power and the Power of Rules (Cambridge University Press), and editor of The Role of Law in International Politics (Oxford University Press) and United States Hegemony and the Foundations of International Law (Cambridge University Press).
