History and International Law: Eastern Europe in a Global Perspective. A Handbook

Second Author Workshop

The juridification of international relations in the form of a dynamically developing code of international law is a universal project of European modernity. However, the history of its development reveals that the origins of a number of principles, regulatory fields, and regimes were highly influenced by regional factors. This is particularly true for the impact that conflicts in Eastern Europe had during the age of nationalism, the decline of empire, and the creation of nation states. The handbook seeks to discover the formative influence that the region exerted on the emergence of modern international law and on international law jurisprudence. To this end, it examines the origins of modern international law from an East-Central and Southeast European perspective and at the same time embeds this history in its transnational and global contexts. The chronological starting point is the 1774–1795 Partition of Poland. For the long nineteenth century and the interwar period, the handbook focusses on the Treaty of Paris in 1856 ending the Crimean War, the Congress of Berlin in 1878, the five major peace treaties of 1919/20 resulting from the Paris Peace Conference, and the founding of the League of Nations in 1920. For the twentieth century, the focus of interest is on the 1948 Genocide Convention of the United Nations, and on the development of international criminal law from Nuremberg to The Hague. The book concludes by examining the development of a Responsibility to Protect on the part of the international community. In a series of author workshops, the GWZO project group on Juridification of International Relations strives to sharpen the focus of the handbook further by discussing papers, and to develop the papers further towards the final version in the handbook.
