Strategic litigation is an acknowledged tool for bringing about significant changes in law, politics, economics and society at large. By taking carefully selected cases to court, it aims not only at enforcing the claimant’s rights, but also at promoting enactment and enforcement of individual rights in general. Many citizens’ initiatives, NGOs or law clinics across the world engage in strategic litigation, especially in other EU member states, in Canada, the USA and Latin America. Meanwhile, in Germany, the tool is not yet used to its full potential.
